Tiesu pavēstu un izpildu rakstu nosūtīšanas elektroniski tiesiskais regulējums

Abstract

Bakalaura darbā „Tiesu pavēstu un izpildu rakstu nosūtīšanas elektroniski tiesiskais regulējums” tiks izvērtētas iespējas tiesu dokumentu nosūtīšanai elektroniskā veidā. Darbā tiek aplūkota trīs tiesu dokumentu veidu nosūtīšanas elektroniski uz e-pastu iespēja. Aplūkotie tiesu dokumentu veidi ir tiesu pavēste, izpildu raksts un tiesas sprioedums. Tiek apskatīta arī ārvalstu pieredze šo dokumentu nosūtīšanai adresātam elektroniskā veidā. Darbā tiek piedāvāti priekšlikumi izmaiņām likumā, lai veiktu dokumentu nosūtīšanu elektroniski uz e-pastu. Darbā autors piedāvā veikt izmaiņas gan Civilprocesa likumā, gan Iedzīvotāju reģistra likumā, lai nodrošinātu tiesām iespēju sūtīt adresātam elektroniski jau pirmo dokumentu apkopojumu, informējot, ka ir ierosināta lieta.

Bachelor Thesis contains evaluation of legal regulation regarding delivering subpoena and writ of execution electronically. The problem formulation of Thesis is to ascertain necessary changes in legal acts in order to send Court documents electronically. Thesis will take a closer look on three types of Court documents – Writ of execution, Suboena and verdicts. For each of these documents necessary requisites and legal basis will be set, to make them legally correct for sending them not only by regular mail, but as well electronically, thus creating an economy of resources. International experience as well will be considered – how in other countries, where it is applicable, is organized delivering of court documents, as well as in which cases it is done. Thesis contains proposals on changes in Law of Proceedings and Population Register, as well as practical suggestions on how to send documents electronically, according to Latvian Law.
