Bakalaura darba nosaukums ir “Darījumu apstrīdēšana maksātnespējas procesos”. Darba tēma ir aktuāla, jo šobrīd gan pasaulē, gan Latvijā jūtama krīze, kuras rezultātā daudzi komersanti nespēj nokārtot savas parādsaistības, kā rezultāta Latvijā ir ievērojami pieaudzis maksātnespējas procesu skaits. Tieši šobrīd notiek jaunā Likumprojekta „Maksātnespējas likums” pieņemšanas process, tādēļ, autoram ir interesanti pētīt un salīdzināt šobrīd spēkā esošā un topošā likuma normas par darījumu apstrīdēšanu.
Bakalaura darbs sastāv no 44.lpp, kuras sevī ietver ievadu, trīs nodaļas, kura katra iedalās sīkāk apakšnodaļās, kopsavilkuma, anotācijas. Darbā izmantoti gan Latvijas, gan ārvalstu likumi, judikatūra, doktrīnas u.c. Darba pirmajā nodaļā tiek apskatīta vispārējā nepieciešamība pēc tiesību normām, kas ļauj apstrīdēt un atzīt par spēkā neesošiem parādnieka veiktos darījumus, kādi vispār ir apstrīdamo darījumu veidi, kā arī analizēti, pēc autora izvēles, divu apstrīdamo darījumu veidu regulējumus Maksātnespējas likumā. Darba otrajā nodaļā autors salīdzina Maksātnespējas likuma un Likumprojekta tiesību normas par darījumu apstrīdēšanu, vērtējot tās attiecībā ar UNCITRAL 2004 ieteikumiem. Darba trešajā nodaļā autors salīdzina Maksātnespējas likuma tiesību normas, kas regulē darījumus, kuri nesasniedz to reālo vērtību un attiecīgās Anglijas Maksātnespējas likuma tiesību normas.
Rezultātā autors nonāk pie secinājumiem un izdara priekšlikumus par to, kādām vajadzētu būt jaunā Maksātnespējas likuma normām par darījumu apstrīdēšanu. Title of the Bachelor’s Paper is “Avoidance of Transactions in Insolvency Proceedings”. Theme of the paper is topical since currently crisis is experienced in the whole world and Latvia, due to which many merchants cannot settle their debt commitments, consequently the number of insolvency proceedings has increased considerably in Latvia. At the moment adoption of the new draft law “The Law on Insolvency” is in process, therefore it is interesting for the author to study and compare the norms of currently effective and the prospective law on disputing of transactions.
The Bachelor’s Paper consists of 44 pages comprising introduction, three sections, each divided in smaller subsections, summary and annotation. Both Latvian and foreign laws, judicature, doctrines have been used in the paper.
In the first section of the paper general necessity for legal norms allowing to dispute transactions performed by the debtor and to declare them null and void, as well as types of the disputable transactions have been reviewed, and, per choice of the author, two types of regulations of disputable transactions in the Law on Insolvency have been analyzed. In the second part of the paper the author compares legal norms on disputing of transactions in the Law on Insolvency and the draft law, evaluating them in relation with recommendations of the UNCITRAL 2004. In the third part of the paper the author compares the legal norms of the Law on Insolvency regulating transactions that do not reach their actual value and accordant legal norms of the Law on Insolvency of England.
As a the result the author comes to conclusions and makes propositions on what the norms on disputing of transactions in the new Law on Insolvency should be like.
