Kriminālteoloģijas kriminoloģiskās problēmas

Abstract

Maģistra darbā pētītas kriminālteoloģijas kriminoloģiskās problēmas Latvijas un pasaules mērogā, ņemot vērā dažādu jauno reliģisko kustību un reliģisko sektu straujo izplatību un to darbībai raksturīgās kriminogēnās tendences. Atšķirībā no pasaules prakses Latvijā jauno reliģisko kustību vai sektu kriminogēnās ietekmes formas kriminālteoloģiskā rakursā ir tik maz pētītas, ka praktiski par šo tēmu Latvijā nav pieejama nekāda zinātniskā literatūra. Ņemot vērā minēto, autore jo īpaši vēlas uzsvērt šī pētījuma attīstības nepieciešamību un lietderību Latvijas prakses veidošanā. Maģistra darba izstrādē izmantota gan ārvalstu, gan Latvijas valsts iestāžu un tiesu prakses analīze. Darbā pētīti tādi jautājumi kā kriminālteoloģijas būtība un kriminoloģiskā izpratne reliģisko normu un reliģiskās apziņas aspektā; reliģiska rakstura noziedzības galvenās iezīmes, tendences, determinanti un motīvi; reliģisko organizāciju iespējamā kriminogēnā ietekme Latvijā un pasaulē, raksturojot kriminogēnās ietekmes sekas, kā arī reliģiska rakstura noziegumu novēršanas normatīvās un institucionālās iespējas Latvijas mērogā. Pētījuma rezultātā autore apzinājusi aktuālos problēmjautājumus, kā arī sniegusi vairākus secinājumus par jauno reliģisko kustību vai sektu darbības pastāvošajām kriminogēnajām tendencēm un to iespējamās attīstības riska faktoriem Latvijā, piedāvājot priekšlikumus to efektīvai novēršanai un Latvijas institucionālās sistēmas un normatīvās bāzes pilnveidošanai.

This MA Paper looks at the criminological problems of the criminal theology in Latvia and the world, by taking into account the rapid spread of various new religious movements and sects, and criminogenic tendencies typically associated with their activities. Contrary to the situation in the world, very little research has been conducted in Latvia into the forms of criminogenic impact created by religious movements or sects with a focus on criminal theology, and there is almost no scientific literature available on this subject. In the light of this, the author would especially like to stress the necessity and usefulness of developing this research for forming the Latvian practice. Analysis of both foreign and Latvian practice of public institutions and courts was used in developing this MA Paper. The paper deals with the following issues: the essence of criminal theology and criminological conception in the context of religious rules and religious consciousness; the main features, tendencies, determinants and motives of criminality of religious nature; the possible criminogenic impact of religious organizations in Latvia and in the world, describing the consequences arising from the impacts, as well as normative and institutional measures designed to prevent crimes of religious nature within Latvia. As a result of the research the author has studied the relevant problematic matters, has drawn several conclusions about the existing criminogenic tendencies in actions of the new religious movements and sects and about the risk factors that might be caused by further development of these tendencies in Latvia, putting forward suggestions for prevention of the factors and improvement of Latvian institutional system and normative basis.
