Noziedzīgi nodarījumi valsts institūciju dienestā- kvalifikācijas problēmas

Abstract

Maģistra darba mērķis ir izvērtēt noziedzīgu nodarījumu valsts institūciju dienestā kvalifikācijas problēmas. Darba uzdevums ir apzināt šīs grupas nodarījumu tiesisko reglamentāciju normatīvajos aktos un iepazīties ar tiesu praksi, norādot uz judikatūru. Darba struktūru veido ievads, trīs nodaļas un secinājumi un priekšlikumi. Pirmajā nodaļā pētīta noziedzīgu nodarījumu valsts institūciju dienestā vēsturiskā attīstība un grupas noziedzīgo nodarījumu sastāvs. Otrajā nodaļā izvērtēts grupas nodarījumu speciālā subjekta jēdziens, bet trešajā nodaļā pētīti noziedzīgo nodarījumu kvalifikācijas risinājumi tiesu praksē. Izpētes un analīzes gaitā ir izdarīti secinājumi par noziedzīgu nodarījumu valsts institūciju dienestā kvalifikācijas problēmām un, nolūkā sekmēt vienveidīgu likuma satura izpratni un prakses pilnveidošanu, ir izteikti vairāki priekšlikumi.

The objective of the study is to assess legal qualification problems of the criminal offences committed in state authority service. The task of the study is to study legal basis of this group of crimes and investigate court practice identifying case law. The master’s paper consists of an introduction, three chapters and theses. The first chapter explores the historical development of the criminal offences committed in state authority service and corpus delicti of these crimes. The second chapter considers the concept of the special subject, and the third chapter reflects the solutions of the legal qualification problems in the courts. Throughout study and assessment, conclusions on problems of legal qualification of the criminal offences committed in state authority service have been drawn and in order to encourage consistent understanding of the content of the law, a number of propositions have been put forward.
