Maģistra darbs apskata valsts apvērsuma jēdzienu, tā juridisko bāzi un problemātiku. Valsts apvērsuma praktiskie aspekti apskatīti Āfrikas kontekstā ar vairākiem Āfrikas valstu piemēriem, īpašu uzvaru liekot uz 2008. gada augusta valsts apvērsumu Mauritānijā, kas ir šī darba praktiskās izpētes objekts.
Darba rezultātā tiek konstatēts valsts apvērsuma juridiskais statuss, jauno režīmu tiesību un pienākumu juridiskie aspekti, to tiesiskās attiecības ar priekšgājēju izdotiem tiesību aktiem un juridiskās sekas attiecībā uz nākošajām valdībām. Darba rezultātā tiek izvirzīti kritēriji, pēc kuriem nosakāms, vai valsts apvērsuma rezultātā pie varas nākušais režīms ievērojis tautas intereses un kādas ir šī režīma sekas saistībā ar demokrātijas ievērošanu, valsts komerctiesību pienākumiem un starptautisko atzīšanu. The present thesis examines the concept of coup d’etat, the legal background and problematic of same. The practical aspects of the coup are looked at in the context of Africa, the examples of coups in African countries with an emphasis to the coup d’etat of August 2008 in Mauritania, the object of the practical research of the thesis.
The thesis establishes the legal status of coup, finds out the legal standing of rights and obligations of the new post-coup regimes, their legal relationship with acts passed by their predecessors, the legal consequences of their decisions in terms of future state governance, and sets out the criteria of how to establish whether the interests of a people have been met by post-coup regimes and what the legal consequences are in terms of state democracy, commercial obligations and international recognition.
