Darba tēma ir dominējošā stāvokļa jēdziens Konkurences tiesībās. Šī tēma ir ļoti aktuāla, jo Latvijā Konkurences tiesību vēsture ir salīdzinoši nesena.
Darba pētījuma objekts ir dominējošā stāvokļa, kolektīvā dominējošā stāvokļa un dominējošā stāvokļa mazumtirdzniecībā jēdziena izpratne, piemērošana praksē. Jēdziena noskaidrošana ir pats pirmais ar ko sākt, lai pareizi iztulkotu, saprastu un piemērotu Konkurences tiesības.
Autore darbā pieskaras arī dominējošā stāvokļa un Konkurences tiesību vēsturei, attīstībai un rašanās nepieciešamībai.
Darba galvenais problēmjautājums un mērķis ir noskaidrot jēdziena „ļaunprātīga izmantošana” tulkojumu, normas pielietošanas pamatu, jo dominējošais stāvoklis kā tāds nav aizliegts. Svarīgs ir jautājums par jauno jēdzienu konkurences tiesībās – dominējošais stāvoklis mazumtirdzniecībā un ar to saistītie problēmjautājumi.
Darba rezultātā autore secināja, ka dominējošā stāvokļa jēdziena izpratnei ir ļoti liela nozīme, jo gadījumos, ja tas tiek nepareizi piemērots, var radīt negatīvas sekas tirgum, patērētājiem un konkurentiem. Autore secina, ka šādu pārkāpumu izmeklēšana ir ļoti komplicēta un sarežģīta. Un šādā situācijā ļoti pozitīvi būtu vērtējami Ministru kabineta noteikumi par šo pārkāpumu konstatēšanu.
Attiecībā uz tirgus definēšanu ir saskatāmas problēmas un neskaidrības, līdz ar to, autore iesaka vadlīnijas, kurās būtu noteikts kā definēt tirgu.
Attiecībā uz tirgus daļu noteikšanu autore atzīmē, ka ļoti pozitīvi vērtējami grozījumi Konkurences likumā, kas atsakās no procentuālo barjeru noteikšanas tirgus daļai.
Skarot jautājumu par dominējošā stāvokļa ļaunprātīgu izmantošanu, autore nonāca pie ierosinājuma par jaunu Konkurences likuma 13. panta redakciju, jo pašreizējā redakcija pantā iekļauj jēdzienu ļaunprātīga izmantošana, kas rada lielas problēmas tieši tulkošanas ziņā, jo, protams, ka tirgus dalībnieku vēlme ir šo pantu tulkot sev par labu un sev izdevīgi.
Attiecībā uz dominējošo stāvokli mazumtirdzniecībā autore nonāca pie secinājuma, ka šāda jēdziena iekļaušana Konkurences likumā neatbilst tā jēgai, būtībai un mērķim. Jēdzienā nav saskatāmi konkurences tiesību subjekti. Autore iesaka šo jēdzienu ieviest citā jau esošā likumā vai izstrādāt jaunu likumu (piemēram, Tirdzniecības likumu), kas regulētu attiecības starp tirgus dalībniekiem, kas nav konkurenti.
Darbs sniedz ieskatu tieši attiecībā uz pašu dominējošā stāvokļa jēdzienu, uz visiem kritērijiem un to analīzi, nonākot pie secinājuma, ka jēdziens un tā izpratne ir pats pirmais un iesākums, lai kaut ko saprastu un pareizi piemērotu, tātad bez jēdziena izpratnes un tā vēsturiskās attīstības ir ļoti grūti to pareizi pielietot un interpretēt. The subject of the present Paper is the concept of the dominant position in the area of competition law. The subject is topical because the history of the competition law in Latvia is comparatively recent.
The target of the Paper is the understanding of the concept of the dominant position, collective dominant position and dominant position in retailing, its practical application. First and foremost, one has to clarify where to begin in order to correctly translate, understand and practically apply the competition law.
Under the Paper the author has touched upon the history of the dominant status and the competition law, their development and the need for them to come about.
The principal issue and aim of the Paper are to come to the translation of the concept of “abuse”, the basis for the application of the said provision because the dominant position per se is not prohibited. Important issue is the new concept in competition law – a dominant position in the retail trade and related issues.
As a result, the author has come to a conclusion that the understanding of the concept of the dominant position is of utmost importance because in case it is wrongly applied it may cause ill consequences to the market, the consumer and the competitors. Under the Paper the author concludes that the investigation of such violations is very complicated and difficult. In view of the current situation a Cabinet of Ministers Regulation on the identification of such violations would be most welcome.
Problems and obscurities are apparent also in respect of the market definition therefore the author proposes guidelines which would stipulate how to define a market.
In terms of market share determination author notes that the very positive changes in the Competition Act, which waives the barrier determining the percentage market share.
Having come to the issue of the abuse of the dominant position, the author has decided to propose a new wording for the Article 13 of the Law On Competition since the current one contains the concept of the abuse of the dominant position that in turn causes substantial problems concerning the translation because it goes without saying that the participants of the market wish to interpret the article to suit their own needs or to gain some benefit for themselves.
With regard to the prevailing situation in the retail trade the author came to the conclusion that such a concept into the Competition Act does not comply with the aim, the spirit and purpose of this law. The concept does not contain the subject of competiton law. The author suggests this concept to incorporate in another law already existing, or developing new law (such as the Trade Act), which govern the relationships between market participants, not competitors.
The Paper provides an overview on the concept of the dominant position in particular, on all criteria and their analyses leading to a conclusion that the concept itself and its understanding is the first aim to be attained in order to understand and correctly apply it meaning that without the understanding of the concept and the historical development it is hard to correctly apply and interpret it.
