Nenodrošinātais kreditors fiziskās personas maksātnespējas procesā
Abstract
Bakalaura darba tēma ir „Nenodrošinātais kreditors fiziskās personas maksātnespējas procesā”.
Bakalaura darba mērķis ir izpētīt fizisko personu maksātnespēju no dažādiem aspektiem, veikt vēsturiskās rašanās izpēti, salīdzināt nenodrošināto ar nodrošināto kreditoru, kā arī rast iespējami labākos risinājumus nenodrošinātā kreditora aizsardzībai.
Lai veiksmīgi sasniegtu izvirzīto mērķi un uzdevumus, bakalaura darbā tiks pētīti nacionālie un starptautiskie tiesību akti, nacionālā tiesu prakse, vietējā un ārvalstu juridiskā literatūra, tai skaitā zinātniskie raksti, juridiskā rakstura publikācijas, kā arī interneta resursi.
Bakalaura darbā uzsvars tiks likts uz vēsturisko attīstību kā šī procesa pirmsākumu izpēti un rašanās būtību, aktuālo un iepriekšēju maksātnespējas regulējumu Latvijā, jēdziena paplašinātu izpēti, procesu, norises gaitu un nenodrošinātā kreditoru lomu procesā un tā iespējamo aizsardzības uzlabojumu.
Darba ietvaros tiks izmantotas trīs dažādas metodes- vēsturiskā, metodiskā un salīdzinošā. Metodes tiks izmantotas dažādās darba daļās, lai daudzpusīgāk apskatītu maksātnespējas procesa vēsturi un regulējumu. Annotation
The title of the diploma paper is “The Unsecured Creditor in the Natural Person’s Insolvency Procedure”.
The aim of the diploma paper is to study natural persons’ insolvency from various aspects, to perform research of its historical development, to compare the situation of secured and unsecured creditor as well as to find out the best possible solutions for the protection of unsecured creditors.
In order to achieve the set goal and tasks, national and international legislation, national jurisprudence, local and foreign legal literature, including scientific articles, publications of legal nature and internet resources, have been investigated in this diploma paper.
The diploma paper focuses on the study of historical development as the dawn of this process, the essence of its development, the regulation of current and preceding insolvency in Latvia, extended study of the concept, process, course of the process as well as the role of unsecured creditor in the process and the possible improvements of his/her protection.
In the course of this work three different methods will be used in order to achieve a successful result – historical, methodological and comparative. These methods will be used in different parts of the work so that the history and regulation of insolvency process are viewed from diverse aspects.
