Mūža ieslodzījums

Abstract

Visā pasaulē cilvēki izdara nežēlīgus noziegumus, par kuru paveikšanu vainīgajām personām piespriež ar brīvības atņemšanu saistītus sodus, t.sk., mūža ieslodzījumu. Kā noziedzīgo nodarījumu piemērus, par kuru izdarīšanu tiesa var piespriest mūža ieslodzījumu, var minēt slepkavību pastiprinošos apstākļos, genocīdu, noziegumus pret mieru u.c. Bakalaura darbā autors sniedz brīvības atņemšanas un, konkrētāk, mūža ieslodzījuma raksturojumu un ar to saistītās problēmas. Galvenā problēma ir mūža ieslodzījumam paredzēto mērķu sasniegšanas varbūtība. Galvenais pētījuma mērķis ir izzināt, cik gan lietderīgs ir mūža ieslodzījuma institūts soda veidu lokā un vai tas sasniedz savus mērķus, kuri arī tiek aprakstīti bakalaura darbā, kā piemēram, resocializācija. Brīvības atņemšana, tostarp mūža ieslodzījums sevī ietver tiesiskus un sociālus aspektus. Viens no bakalaura darba mērķiem ir šos aspektus izpētīt un veikt to salīdzināšanu ar senāk valdošajiem uzskatiem. Līdz ar to darbā ir uzsvērts, ka galvenais pētīšanas priekšmets mūža ieslodzījums tiek analizēts paralēli brīvības atņemšanas sodam. Mūža ieslodzījums ir brīvības atņemšanas veids. Tādējādi šo abu jēdzienu vēsturiskā attīstība, piemērošana, izpilde, mērķi, funkcijas un būtība ir pētīta kopsakarā.

People commit felonies all around the world. As a result, these people are convicted to penalties linked with imprisonment including life imprisonment. Examples of crimes for which a person could recieve life sentece include murder in strengthen conditions, genocide, crimes against the peace and others. In the bachelor paper an author gives an explanation of imprisonment and life imprisonment and the problems which are linked with these to penalties. The main problem is hidden in the question – does the life imprisonment reaches it’s targets? The main target and task of the paper is to find out how useful the life imprisonment is in the range of the criminal penalties and does it reaches it’s goals, which are described in the bachelor paper for example resocialising. Imprisonment including life imprisonment embodies judicial and social aspects. One of the goals of the bachelor paper is to research these aspects and to compare them with earlier dominating opinions. So it is highlighted in this paper that the main subject of research (life imprisonment) is being researched along with imprisonment at the same time. Life imprisonment in Latvia is a form of imprisonment. That is why author researches the historical evolution, application, execution, goals, functions and an esence of these two penalties at the same time.
