Uzturlīdzekļi, bērna tiesības tos saņemt un sekas, kas izriet no vecāku izvairīšanās tos maksāt

Abstract

Bakalaura darbā autore pēta jautājumu par uzturlīdzekļu saistībām, kā divpusēja rakstura saistībām, kas rodas augšupējo un lejupējo starpā, kā arī bērna tiesības saņemt uzturu no saviem vecākiem un sekas, kas izriet no vecāku izvairīšanās tos maksāt. Kopumā darbs ir veltīts problēmjautājumu izpētei, kas rodas vecākiem nemaksājot uzturlīdzekļus, arī gadījumā, ja tie tiek izmaksāti no Uzturlīdzekļu garantiju fonda un attiecībā uz bērnu (lejupējo) pienākumu maksāt uzturlīdzekļus vecāku labā, kā arī sekām, kas uztura nesniegšanas gadījumā var rasties mantojuma tiesību aspektā. Mērķa sasniegšanai darbā ir aplūkoti sekojoši jautājumi: - uzturlīdzekļu saistību vēsturisko pirmsākumu aplūkošana; - uzturlīdzekļu saistību rašanās un pārtraukšanas priekšnosacījumu esamība bērnu un vecāku starpā; - starptautisko un Latvijas Republikas normatīvo aktu izpēte, no kuriem izriet bērnu tiesības saņemt uzturlīdzekļus un uzturlīdzekļu maksāšanas pienākums; - Uzturlīdzekļu garantiju fonda darbības izpēte un personu iekļaušana parādnieku sarakstos; - bērna (lejupējā) tiesību nerūpēties par saviem vecākiem izpausme; - uztura nesniegšanas sekas saistībā ar mantošanas tiesībām, neatraidāmo mantinieku atstumšanas tiesības. The author of the Bachelor thesis researched the issue of maintenance obligations as a bilateral commitment, resulting from the relations between a child and his parents, as well as children's rights to receive child support from their parents and possible consequences if parents elude to pay it. In general, the aim of the research is to study problems which appear when the child support that had to be paid by the parent was provided from the Maintenance Guarantee Fund, which may give the child the right to deny his/her own maintenance obligations towards the parent, as well as possible consequences for non-paying parents in connection with the law of succession. To achieve the aim the following issues are observed: - historical origin of maintenance obligations; - setting up and interruption of maintenance obligations between a child and his/her parents; - study of the international law and Latvia's national legislation that defines children's rights to receive child support and maintenance obligations as such; - activities performed by Administration of the Maintenance Guarantee Fund and creation of the defaulters register; - children's rights to deny their maintenance obligations towards the parents; - possible consequences for non-paying parents in connection with the law of succession. The results of the research have shown that in author's opinion there is a need to introduce changes in Latvia's national legislation.
