Apstākļi, kas ietekmē soda noteikšanu par slepkavību, kas izdarīta pastiprinošos apstākļos

Abstract

Bakalaura darba mērķis ir izpētīt atbilstoša un likumīga soda noteikšanas īstenošanas problēmjautājumus, kā arī veikto Krimināllikuma grozījumu ietekmi uz turpmāko soda noteikšanu personām, kuras veikušas noziedzīgus nodarījumus. Ir nepieciešams konstatēt teorētisko regulējumu, kā arī krimināltiesību profesoru, praktiķu un attiecīgās nozares literatūras autoru paustās atziņas konkrētajā jautājumā, lai gūtu priekšstatu par atbilstošu Krimināllikumā ietverto normu piemērošanu Latvijas tiesību sistēmā. Lai to noteiktu, tiek analizēti tiesu spriedumi, kā arī autors sniedz iespējamos risinājumus soda mērķa un soda noteikšanas vispārīgo principu attīstībai nākotnes krimināltiesību regulējumā.

The purpose of this Bachelor Thesis is to research the issues of an appropriate and legitimate imposition of a sentence and also study the influence of the amendments of criminal law to the following imposition of a sentence for people that have done a crime. It is necessary to understand the theoretical regulation and also the implied thoughts of professors of criminal justice, practicians and authors of the literature in this particular sphere to get an understanding about the appropriate way to adjust the criminal law to latvian legal system. In order to do that, the author analyses the sentences made by the court and gives some possible solutions for future amendments of criminal law.
