Evaluation of the evidence is the mental process of thinking, so in the law it is not possible to describe and detail all the process of evidence evaluation. Thus, the non-procedural concept appears in the civil procedure, which causes difficulties in courts.
The author is convinced that there is nothing more practical than a good theory, so the object of the study is to explore the concept of a non-procedural nature of definitions.
The author proposes to include in the Civilprocesa likums definition of means of evidence and the definition of the concept of truth in civil procedure. Author also concludes that judges may use the scientific knowledge of people who have not been granted scientific degree.
