Krimināllikuma 174. panta analīze

Abstract

Krimināllikumā 174.pants,ir vienīgais pants,kurš noteiktu atbildību par cietsirdīgu vai vardarbīgu attieksmi pret nepilngadīgajām vai mazgadīgajām personām.KL 174.panta piemērošana Latvijā nav izplatīta,un līdz ar to,nav arī vienota panta sastāva skaidrojuma.Analizējot KL 174.pantā ietvertā noziedzīgā nodarījuma sastāvu,var sastapties ar dažādu jēdzienu skaidrojumu,izpratni un to piemērošanu praksē.Darba pamat uzdevums ir veikt KL 174.pantā ietvertā noziedzīgā nodarījuma dispozīcijas analīzi,tas ir,izpētīt katra jēdziena nozīmi un izskaidrot to,nonākot pie konkrētas interpretācijas;novilkt robežas starp tādiem jēdzieniem kā cietsirdība un vardarbība,fiziskas un psihiskas ciešanas;noskaidrot un noteikt to personu loku,kuras tiek uzskatītas par vainīgajām saskaņā ar K 174.pantu;noteikt,kādos gadījumos KL 174.pants var un nevar būt piemērojams kopībā ar citiem KL pantiem.

Section 174 of the Criminal Law is the only provision that would impose liability for cruel and violent treatment of juveniles or minors.The application of the Section 174 of the Criminal Law is not common in Latvia,and hence,there is no single explanation of the paragraph composition.Analyzing the substance of criminal offense expound in the Section 174 of the Criminal Law,one may face a variety of definitions,understanding and their application in practice.The main task of the study is to conduct reflected in the Section 174 of the Criminal Law offense disposition analysis,that is,to explore every concept meaning and explain it,arriving at a specific interpretation;to draw the boundaries between the concepts of cruelty and violence,physical and mental suffering,find and identify persons affected by this law,who shall be held guilty under the Section 174;to determine the cases in which the Section 174 of the Criminal Law can and cannot be applied in communion with the other sections.
