Atvaļinājumu tiesiskais regulējums, problēmsituācijas un to risinājumi

Abstract

Atvaļinājumi ir tas laiks, kuru darbinieki gaida ar nepacietību, taču šo jomu regulē vairāki normatīvie akti, kuru nezināšana vai neievērošana var radīt arī nevēlamas situācijas. Tādēļ gan darbiniekiem, gan darba devējiem ir svarīgi zināt, kā pareizi interpretēt Darba likuma regulējumu šajā sfērā un kā to piemērot netipiskos apstākļos. Tā kā vēl joprojām ir neskaidrības dažādās atvaļinājumu piešķiršanas niansēs, tad autore darbā meklē atbildes uz tiem jautājumiem, ar kuriem praksē nākas sastapties visbiežāk, un piedāvā savus risinājumus komplicētākajiem no tiem. Pētījuma mērķi: Izpētīt ar atsevišķiem atvaļinājuma veidiem saistītos normatīvo aktus, konstatēt izplatītākās problēmsituācijas, ko rada to piemērošana praksē, un sniegt informāciju par šādu situāciju risināšanu. Darbs sastāv no septiņām nodaļām un septiņām apakšnodaļām, kā arī trīs pielikumiem.

Holidays are the time which employees are waiting with impatience, but this area is regulated by several laws, the ignorance or failure to comply may result in undesirable situations. Therefore for both employees and employers, it is important to know how to properly interpret the labor law framework in this area and how to apply it in unusual circumstances. Since there are still uncertainties in various nuances of granting leave, the author of the work looks for the answers to those questions which come across most often in practice and offer solutions to the most complex questions. Objectives of the Study: Exploring the individual types of leave related to legislation, to find the most common problem being caused by the practical application, and to provide information about such situations. The work consists of seven chapters and seven subdivisions, as well as three appendices.
