Kopš Satversmes tiesas sprieduma Civillikuma 358. un 364. pants tika atzīti par spēkā neesošiem un līdz šā 2013. gada 1. janvārim nebija attiecīga regulējuma, tad darba mērķis ir noskaidrot, ko nozīmē ierobežota rīcībspēja, ko tā sevī ietver, kā arī izvērtēt jauno regulējumu, tā vietu Latvijas civiltiesībās. Darbā apskatīta daļējas rīcībspējas institūta rašanās gan Satversmes tiesas spriedums, gan Eiropas Cilvēktiesību tiesas prakse. Apskatīts jaunajā Civillikumā ietvertās tiesības personām ar ierobežotu rīcībspēju, kādas tās bija pirms civillikuma grozījumiem un kādas tās ir pēc grozījumiem. Apskatīti arī problēmjautājumi saistībā aktuālo tiesu praksi. Noskaidrojot, kādi likuma uzlabojumi nepieciešami un kā jaunās normas izprot Latvijas tiesas. Since the Constitutional Court verdict Civil Law 358th and 364th article was invalidated and till year 2013 1st January was not the appropriate regulation, the work aims to clarify what is meant by 'limited capacity', which it includes, as well as to evaluate the new regulation, it's place in the Latvian civil law.The paper deals with a partial capacity institute the emergence of the Constitutional Court verdict, and the European Court of Human Rights practice.Viewed now included in the Civil Law rights of persons with limited capacity, as it was before the amendments of civil law and what they are, as amended. Also addressed concerns regarding the current case law. Clarifying what improvements are needed in the law and the rules of the new understanding of the Latvian courts.Keywords - partial capacity, capacity constraints, Civil Law amendments theoretical research method, the guardianship, people with mental and other health problems, the new Civil Law regulations.
