Maģistra darbā „Kriminālatbildība par ceļu satiksmes noteikumu un transportlīdzekļu ekspluatācijas noteikumu pārkāpšanu” ir pētīts un analizēts Krimināllikuma 260.pantā ietvertais regulējums, kas paredz atbildību par ceļu satiksmes un ekspluatācijas noteikumu pārkāpšanu, papildus analizējot Krimināllikuma 262.pantā paredzēto atbildību par transportlīdzekļa vadīšanu alkohola, narkotisko, psihotropo, toksisko vai citu apreibinošu vielu ietekmē, kā arī tiek apskatīts noziedzīgo nodarījumu pret ceļu satiksmi regulējums ārvalstu krimināllikumos.
Darbā analizētas dažādas teorētiskas un praktiskas problēmas, piemēram, par atbildības diferenciācijas ietveršanu Krimināllikuma 260.pantā atkarībā no personas subjektīvās attieksmes pret Ceļu satiksmes noteikumu pārkāpšanu, kā arī bojā gājušo personu skaita. Tāpat ir pētīti un analizēti ceļa un transportlīdzekļa jēdziena trūkumi, analizēta līdzdalības iespējamība Krimināllikuma 260.pantā ietvertajam noziedzīgajam nodarījumam u.c. problēmjautājumi.
Darba struktūru veido 4 nodaļas, kur 1.nodaļā veikts svarīgāko jēdzienu raksturojums, 2.nodaļā – Krimināllikuma 260.panta sastāva analīze, 3.nodaļa veltīta kriminālatbildības par transportlīdzekļa vadīšanu vai mācīšanu vadīt transportlīdzekli alkohola, narkotisko, psihotropo, toksisko vielu vai citu apreibinošu vielu ietekmē izpētei, 4.nodaļā pētīta atbildības par ceļu satiksmes noteikumu reglamentāciju ārvalstu krimināllikumos.
Darbā izmantoti Latvijas, kā arī ārvalstu tiesību zinātnieku darbi, normatīvie akti un tiesu prakse. Papildus izmantoti speciālie izdevumi un interneta resursi. The master thesis “Criminal liability for the violation of the traffic code and the operating rules” explores and analysis the regulation of Article 260 of the Criminal Law that provides liability for the violation of the traffic code and the operating rules with an additional analysis of Article 262 that provides liability for drunken or drugged driving and gives a brief survey on the regulation of traffic code breaches in foreign countries.
The study includes several theoretical and practical problems, as differentiation of liability according to Article 260 of the Criminal Law depending on the person’ s subjective attitude to the breach of traffic code and the amount of casualities. It also analyses and explores the problem of imperfections of the terms ‘ road’ and ‘vehicle’, the problem of togetherness of Article 260 and Article 262, the probability of accessory at breaches mentioned in Article 260 and other problematic questions
The study consists of 4 chapters, the first chapter contains the characteristic of the most important terms, the second – the analysis of Article 260 of the Criminal Law. The 3rd chapter is dedicated to criminal liability for drunken or drugged driving or teaching to drive. The 4th chapter analyses liability in traffic code reglamentations of foreign countries.
Works of Latvian and foreign legal scientists as well as legislation acts and proceeding practice have been used in the study. Special editions and Internet materials have been used additionally.
