Pārstāvis civilprocesā

Abstract

Bakalaura darbs „Pārstāvis civilprocesā”. Darba mērķis ir padziļināti izpētīt Latvijas Republikas Civilprocesa likumā esošā regulējuma tiesiskumu un lietderīgumu attiecībā uz to, ka par pilnvarotu pārstāvi civilprocesā var būt jebkura fiziskā persona (ievērojot noteiktos ierobežojumus). Kā arī, izvērtējot pašreizējos tiesībpolitiskos un ekonomiskos apstākļus Latvijas valstī, apsvērt nepieciešamību piešķirt zvērinātiem advokātiem kā pārstāvjiem civilprocesā ekskluzīvas tiesības, it īpaši kasācijas tiesvedībā. Līdz ar to bakalaura darba pētījuma robežās galvenokārt tiek salīdzināta tādu pārstāvju civilprocesā darbība kā zvērināti advokāti un personas, kurām nav zvērināta advokāta kvalifikācijas. Pētījuma rezultātā tiek piedāvāti ieteikumi normatīvā regulējuma grozījumiem. Atslēgas vārdi: Civilprocess, pārstāvis, zvērināts advokāts, persona, kurai nav zvērināta advokāta kvalifikācijas.

The bachelor’s thesis „A representative in a civil proceeding”. The goal of the paper is to make a profound research on existing in the civil proceeding’s law of the Republic of Latvia regulation of justice and benefits regarding the fact that an authorized representative in a civil proceeding can be any individual (considering certain limitations). Moreover, evaluating current judicial and economic situation in Latvia, the necessity of exclusive rights granting to barristers as representatives of the civil proceeding, especially in the court of cassation, is considered. Consequently, within the bachelor thesis mainly the action of the following representatives of the civil proceeding is compared: barristers and the individuals who do not possess the qualification of a barrister. The result of the research provides the recommendations for the amendments of normative regulations.
