Ieroču, munīcijas, sprāgstvielu, radioaktīvu un bīstamu vielu glabāšanas, izlietošanas, uzskaites un pārvadāšanas noteikumu pārkāpšana

Abstract

Par noteikumu pārkāpumiem, kas saistīti ar ieroču, munīcijas, sprāgstvielu, radioaktīvu un citu bīstamu vielu glabāšanu, izlietošanu, uzskaiti un pārvadāšanu, militārpersonām saskaņā ar Krimināllikuma 346.pantu ir paredzēta kriminālatbildība, taču ar pēdējiem likuma grozījumiem tika mainīts šī noziedzīgā nodarījuma sastāvs, papildinot to ar būtisku kaitējumu kā kvalifikācijas pamatpazīmi, kas šobrīd nozīmē, ka militārpersonu atbildība par prettiesiskām darbībām pret paaugstinātas bīstamības priekšmetiem tiek ierobežota. Bakalaura darbs satur trīs nodaļas, kurās analizēts Krimināllikuma 346.panta nozieguma sastāvs, tā aktualitāte un problēmu spektrs, kas saistīts ar tā kvalifikāciju.

For the breach of the rules on the storage, use, record- keeping and transportation of the weapons, ammunition, explosives, radioactive and dangerous substances, a military can be liable under the Article 346 of The Criminal Law, though after the latest amendments of the law, the corpus delicti of this offence was altered – supplemented with a “major damage” as a fundamental for classifying the offence, which now means that the liability of the military for their unlawful acts against objects with high dangerousness has been limited. The Bachelors thesis consists of 3 main chapters, in which the corpus delicti of the offence provided in the Article 346 of The Criminal Law has been analyzed, as well as its topicality and the spectrum of problems related to the legal classification of the offence.
