Uzturlīdzekļi pilngadīgajiem bērniem

Abstract

Darba mērķis – izpētīt, kāds ir uzturlīdzekļu pilngadīgajiem bērniem regulējums Latvijā un Vācijā, rast priekšlikumus uzturlīdzekļu pilngadīgajiem bērniem regulējuma un tiesas darba uzlabošanai Latvijā. Lai sasniegtu mērķi: 1.aplūkoti Latvijā esošie normatīvie akti, kuri regulē uzturlīdzekļu pilngadīgajiem bērniem institūtu un analizētas ar to saistītās likumu normas; 2.pētīta tiesu prakse pilngadīgo bērnu uzturlīdzekļu problemātiskajos jautājumos; 3.izdarīti secinājumi par tiesu praksi apskatītajās lietās; 4.doti priekšlikumi kā pilnveidot uzturlīdzekļu piedziņu pilngadīgajiem bērniem; 5.izpētīts uzturlīdzekļu pilngadīgajiem bērniem regulējums Vācijā; 6.veikta salīdzinošā analīze ar Latvijas regulējumu. Autore izvirza vairākus priekšlikumus, ņemot vērā Vācijas normatīvos aktus, Latvijas tiesu praksi, Latvijas normatīvo aktu uzlabošanai. Uzlabojumi nepieciešami, lai Latvijas normatīvos aktus padarītu mūsdienīgākus, kā arī atvieglotu darbu amatpersonām, kuras ir atbildīgas par uzturlīdzekļiem un pilngadīgajiem bērniem, kuri prasa uzturlīdzekļus no saviem vecākiem.

The aim of the study is to investigate the legislation of maintenance for adult children in Latvia and Germany, to seek proposals for improving the regulation of maintenance for adult children and the work of the Latvian court. In order to achieve the objective, the author has: 1.discussed current Latvian legislation, which regulates the institute of mainintance for adults children and analyzed the associated rule of law; 2.studied the jurisprudence problematic issues in maintenance for adult children; 3.drawn conclusions about the cases of maintenance for adult children; 4.given recommendations for how to improve the recovery of maintenance adult children; 5.studied the legislation of adult maintenance in Germany; 6.performed a comparative analysis of the German and Latvian legislation.

The author puts forward some proposals in the light of German laws and regulations, to improve Latvian case law and Latvian laws and regulations. The improvements are needed to make Latvian laws and regulations more modern, and facilitate the work of officials who are responsible for the maintenance for adults and for thouse who require maintenance either from their parents, children or spouse.
