Ģimenes kā juridiska jēdziena nostiprināšana Latvijas Ģimenes tiesībās

Abstract

Civillikums nosaka šauru ģimenes definējumu, kas nav efektīva, savukārt Latvijas Republikas Satversme nosaka, ka valsts pienākums ir atbalstīt un aizsargāt ģimeni, bet neizskaidro, kas ir ģimene. Bakalaura darba mērķis ir, izveidot precīzu ģimenes definīciju, kā šaurākā tā arī plašākā izpratnē, kas tiktu nostiprināta Civillikumā Ģimenes tiesību daļā, nošķirt laulības no ģimenes plašākas izpratnes un partnerattiecības no ģimenes šaurākas izpratnes, aizstāvēt pamatdomu, ka ģimenes tiesiskās attiecības veidojas sākotnēji starp vecākiem un bērniem nevis starp laulātajiem. Autore noslēgumā sasniedz darba mērķi un nonāk pie Civillikuma 214. panta grozīšanas, piedāvājot to izteikt jaunā redakcijā, kur ir ietverta šaurāka un plašāka ģimenes tiesiska izpratne. The definition of family in the Civil Law is narrow, which is not effective, while the Constitution of Latvia determines that the state has the duty to support and protect the family, but it does not interpret what a family is. The aim of the bachelor’s thesis is to create a precise definition of family, in both narrower and broader understanding, that would be strengthened in the Civil Law in Family rights department, to separate marriage from a broader understanding of family and partnership from a narrower understanding of family. In conclusion the author reaches the aim of the thesis and comes to modification of the 214. clause of the Civil Law, offering to declare it in a new formulation with narrower and broader legal understanding of family.
