Kriminālprocesa likuma 379. pants ļauj kriminālprocesu izbeigt, atbrīvojot personu no kriminālatbildības. Galvenais problēmjautājums ir par Kriminālprocesa likuma 379. panta interpretāciju. Normai jābūt formulētai tik precīzi, lai nevarētu to interpretēt dažādi. Darbā analizēta norma, norādīts uz nepilnībām tajā, kā arī sniegti ierosinājumi normas precīzākai formulēšanai.
Pētījuma mērķis ir sniegt pilnīgu Kriminālprocesa likuma 379. panta izpratni un norādīt uz nepilnībām normā, kas varētu radīt draudus tam, ka norma var tikt nepareizi piemērota. Pētījuma uzdevums ir pētīt normatīvos aktus, juridisko literatūru, kā arī tiesu praksi, lai nonāktu pie precīzas normas interpretācijas. Darba rezultāts ir Kriminālprocesa likuma 379. panta precīza interpretācija, norādes uz nepilnībām pantā un ieteikumi grozījumiem.

Article 379 of the Criminal Code enables to terminate the Code of Criminal procedure and bail a person out from criminal liability. The main problem is the precise interpretation of the Article 379. It must be defined as accurate as nor interpreted different. This graduation paper contains and analyses the law, indicates the imperfection of it as well as introduces to the precise definition of the Article.
The aim of the research is to report complete comprehension of the Article 379 of the Code of Criminal procedure and indicate the imperfection of it that can constitute a menace to apply the law incorrectly.
The objective of the research is to do a case study about laws and regulations, the law literature also jurisprudence to achieve the precise interpretation of the Article.
As a result this paper defines the Article 379 of the Code of Criminal procedure accurately, indicates the imperfection of it and reports advices amendments of law.
