Kriminālatbildība par personu reliģisko jūtu aizskaršanu vai naida celšanu (Krimināllikuma 150. pants)

Abstract

Krimināllikuma 150.pants paredz atbildību par personu reliģisko jūtu aizskaršanu vai naida celšanu sakarā ar šo personu attieksmi pret reliģiju vai ateismu. Latvijas tiesu praksē un krimināltiesību teorijā (doktrīnā) nav nostiprinājušās atziņas par šī panta piemērošanu. Autore savā darbā analizē Krimināllikuma 150.panta sastāvu, pievēršot uzmanību arī gadījumiem, kad Krimināllikuma 150.pantā paredzētais sastāvs saduras ar tiesībām uz vārda brīvību. Analizējot un pētot Eiropas Cilvēktiesību praksi un krimināltiesību doktrīnas, autore piedāvā atzīt personas reliģijas brīvība par Krimināllikuma 150.panta tiešo noziedzīgā nodarījuma objektu. Article 150 of the Criminal Law provides for criminal responsibility for the violation of religious feelings or incitement of hatred because of a person’s attitude towards religion or atheism. Latvian court practice and criminal law theory (doctrine) are not firmly established in the knowledge of the application of this Article. The author in her work analyzes the content of the Criminal Law Article 150 as well as pays attention to its collision with the right to freedom of expression. By analyzing the European human rights practice and criminal law doctrines, the author proposes to recognize the freedom of religion as a direct object of criminal offence under Article 150 of the Criminal Law.
