Speciālās izmeklēšanas darbības, kas ierobežo indivīdu konstitucionālās pamattiesības

Abstract

Bakalaura darba tēma ir “Speciālās izmeklēšanas darbības, kas ierobežo indivīdu konstitucionālās pamattiesības”.Autores izvirzītais bakalaura darba mērķis ir speciālo izmeklēšanas darbību teorētiskās bāzes, tiesiskās reglamentācijas, kā arī prakses materiālu detalizēta analīze. Pētīšanas mērķis - konstatēt speciālo izmeklēšanas darbību institūta gan teorētiskus, gan praktiskus problēmjautājumus un izvirzīt to risināšanas priekšlikumus, kā arī izanalizēt un salīdzināt speciālās izmeklēšanas darbības un operatīvās darbības pasākumus. Bakalaura darba pētījuma problemātika ir saistīta ar to, ka speciālo izmeklēšanas darbību institūta tiesiskā un likumiskā bāze, nonāk pretrunā ar Latvijas Republikas Satversmes 96.pantā, kā arī starptautiskos cilvēktiesību dokumentos garantētajam ikvienas personas tiesībām uz privāto dzīvi, mājokļa un korespondences neaizskaramību.

The subject of the Bachelor’s thesis is “Special Investigation Activities that Restrict the Fundamental Constitutional Rights of Individuals”. The goal of the Bachelor’s thesis proposed by the author is a detailed analysis of theoretical basis, legal regulation and practical materials of special investigation activities. The purpose of the research is to establish both the theoretical and practical problem issues of the special investigation activity, and to bring forward proposals for their solution, as well as to analyse and compare the special investigation activities and the activities of investigatory operations. Problems of the Bachelor’s thesis research are related to the fact that the legal basis of the special investigation activity is contrary to the rights of every person to a private life, inviolability of home, and correspondence guaranteed in Section 96 of the Constitution of the Republic of Latvia as well as in international human rights documents.
