Noziedzīgi iegūtas mantas konfiskācija salīdzinot ar mantas konfiskāciju, kā soda sankciju, ir efektīvāks veids, lai atņemtu noziedzīgi iegūto, jo ļauj tiesību aizsardzības iestādēm izsekot mantas rašanās ceļus un atņemt arī mantu, kas nepieder apsūdzētajam, bet tās sākotnējā iegūšana bija nelikumīga.
Mantas noziedzīgās izcelsmes pierādīšana ir sarežģīts process, kam nav izstrādāti kopēji principi tiesību aizsardzības iestādēs, tāpēc nereti noziedzīgi iegūtas mantas meklēšana kriminālprocesā atvirzās otrajā plānā. Līdz ar to netiek sasniegts krimināltiesisko attiecību taisnīgs noregulējums.
Darba mērķis ir analizēt legālās prezumpcijas piemērošanu noziedzīgi iegūtas mantas pierādīšanā un parādīt izmeklēšanas darbības, kas ļauj iegūt pierādījumus noziedzīgi iegūtas mantas esamībai. Izmeklēšanas satura standartizācija finanšu izmeklēšanā būtu būtisks sasniegums, lai noziedzīgi iegūta manta tiktu konfiscēta lielākā apjomā.
