Grūtnieču un maternitātes stāvoklī esošo sieviešu darba tiesisko attiecību nodibināšanas un ar darba devēja uzteikumu saistītie tiesiskie aspekti

Abstract

Darba mērķis ir veikt pētījumu par Darba likuma tiesiskā regulējuma atbilstību Eiropas Savienības tiesībām un judikatūrai, noskaidrot darba tiesisko attiecību nodibināšanas un ar darba devēja uzteikumu saistītos tiesiskos aspektus attiecībā uz sievietēm grūtniecības un maternitātes stāvoklī. Darba rezultātā secināts, ka Darba likuma normas, kas paredz grūtnieču un sieviešu maternitātes stāvoklī aizsardzību, atbilst Eiropas Savienības tiesībām, Eiropas Savienības tiesas judikatūrai, tomēr Darba likumā būtu vēlams veikt izmaiņas attiecībā uz augstāk minēto personu terminu skaidrojumiem, lai noteiktu aizsardzības sākuma laiku un personu loku, uz kurām tā attiecas, tiek piedāvāts grozīt Darba likuma 47.panta pirmo daļu, 109.panta pirmo daļu. Darbs sastāv no 3 nodaļām, kas iedalītas sīkāk apakšnodaļās. Darba apjoms ir 48 lapas. Darba temata izpētē ir izmantota literatūra, normatīvie akti, tiesu prakse temata kontekstā.

The objective of the thesis is to conduct a study regarding Latvian Labor (LL) law compliance with EU law, case law, and to understand legal aspects of establishment and termination of employment for women during pregnancy and maternity period. As a result it has been concluded that LL law terms which regulates women protection during pregnancy and maternity period complies with EU law and Court of Justice of the EU case law,however LL Law requires some amendments to be made in order to obtain more precise definition for abovementioned persons,and my strong opinion is that it will ensure the possibility to determine the commencement of the period and group of persons protection applies to,suggestion is to amend 1st part of article 47 and 1st part of article 109 of LL law. The thesis consists of 3 chapters which are further divided in to subsections. The volume of the thesis is 48 pages. During the research literature, laws and case laws has been used in the context of thesis object.
