Valsts kompensācija cietušajiem

Abstract

Autore bakalaura darbā „Valsts kompensācija cietušajiem” ir apskatījusi valsts kompensācijas institūtu, īpašu uzmanību darbā veltot procesuālajam regulējumam, sasaistot to ar tiesu praksi un citu valstu procesuālo regulējumu. Autore analizējusi starptautiskos dokumentus un tiesu praksi, vērtējot to atstāto iespaidu uz nacionālā regulējuma tiesību normu piemērošanu un interpretāciju. Bakalaura darbā autore vērtējusi vai valsts noteiktais kompensācijas apmērs ir tiesisks un samērīgs starptautisko dokumentu izpratnē. Darbā tiks izvirzīti priekšlikumi tiesību normu uzlabošanā, grozīšanā, papildināšanā. Bakalaura darba tēmu „Valsts kompensācija cietušajiem” autore izvēlējās, jo šis institūts Latvijā tika ieviests salīdzinoši nesen, 2006. gadā. Likums tika izstrādāts steigā, lai ievērotu Eiropas Padomes 2004.gada 29.aprīļa Direktīvā 2004/80/EK par kompensāciju noziedzībā cietušajiem noteikto direktīvas īstenošanas termiņu 2006. gada 1. janvāri.

Author of bachelor work „State compensation for victims” has researched state compensation institute, devoting special attention to the procedural half, connecting it with the jurisprudence and with other foreign procedural regulations. Author analyzed the international documents and jurisprudence, assessing at their impress to our national regulatory rules and of their interpretation. In this bachelor work author assessed whether the determined amount of compensation in our contry is reasonable and appropriate in international documents meaning. Author will offer proposals for amending, supplementing to improve legislation. Author chose Bachelor's work „State compensation for victims” because state compensation intitute in Latvia was created relatively recently, in year 2006. The law was elaborated in a hurry to comply with the Council Directive 2004/80/EC relating to compensation to crime victims. The Directive's implementation deadline was 1st January of year 2006.
