Abstract

Darba tēma ir dienesta viltojums. Dienesta viltojums ir noziedzīgs nodarījums, kurš sevī ietver kaitējuma nodarīšanu valsts un pašvaldību institūciju, valsts dienesta normālai darbībai, kā arī personām un to tiesībām un likumiskajām interesēm. Darbā tiek analizēti noziedzīgā nodarījuma sastāva elementi, lai nošķirtu dienesta viltojumu no citiem noziedzīgiem nodarījumiem, kuri saistīti ar viltošanu, tādā veidā nodrošinot pareizu 327.panta piemērošanu. Viens no aktuālākajiem jautājumiem ir, vai neīsta dokumenta sastādīšana ir uzskatāma par dienesta viltojumu. Darbā tiek izmantota vēsturiskā , analītiskā , salīdzinošā un induktīvā metode, lai nonāktu pie vispārējiem secinājumiem. Darba rezultātā tiek norādīts uz iespējamām nepilnībām tiesiskajā regulējumā un piedāvāti konkrēti risinājumi nepilnību novēršanai Krimināllikuma XXIV nodaļas 327.pantam „Dienesta viltojums”.

The theme of diploma thesis is forgery. Forgery is a criminal offense which involves damage to the national and local goverment, public service normal operation, as well as individuals and their rights and legal interests. Diploma analyzes the constituent elements of the offense in order to distinguish forgery from other offenses related to counterfeiting, thus ensuring the correct application of 327.article. One of the most relevant questions is whether the false document preparation service is considered to be a forgery. There are historical, analytical, comparative, inductive methods used in diploma to arrive at general conclusions. Result of work addresses to the possible weaknesses in the legal framework and proposes specific solutions to address the weaknesses of Chapter XXIV of the Criminal law 327.article "Forgery".
