Notariālā akta formai kā publiskam dokumentam ir būtiska nozīme civilprocesā, tādēļ Latvijā ir nepieciešams palielināt esošā latīņu tipa notariāta efektivitāti, nosakot plašāku darījumu loku obligāta notariālā akta formā.
Autore piedāvā noteikt obligātu notariālā akta formu darījumiem ar nekustamiem īpašumiem. Šo darījumu iekļaušana zvērinātu notāru ekskluzīvā kompetencē garantētu uzraudzību no valsts puses, personu interešu un tiesību aizsardzību.
Darbā tiek apskatītas Latvijas notariātu raksturojošās pazīmes, notariālo aktu un citu apliecinājuma veidu būtiskās atšķirības, kā arī izvērtēta pašreizējā šo darījumu veikšanas kārtība un zvērinātu notāru viedokļi. Notarial act as a public document has a significant meaning during the civil procedure thus there is a necessity to improve the efficacy of Latin type notary office in Latvia by requiring a mandatory notarial act for a broader range of transactions.
The author offers a requirement for a mandatory notarial act for transactions concerning real estate properties. The inclusion of these transaction in the competence of sworn notaries would warrant a supervision on the part of the state, as well as it would ensure the protection of person interests and rights.
The present paper reviews characteristics of notary offices in Latvia, significant differences between notarial acts and other forms of certification, as well as ot reviews the current transaction procedure and opinions of sworn notaries.
