| dc.description.abstract | Bakalaura darba tēma ir “Ārstniecības personas profesionālo pienākumu nepienācīga pildīšana”, darbā veikta Krimināllikuma 138.panta noziedzīgā nodarījuma un ārvalstu tiesību aktu analīze, pētīta panta piemērošana praksē. Autore iesaka Pacientu tiesību 6.panta 2.daļu izteikt šādā redakcijā – “pēc pacienta vai ārstējošā ārsta pieprasījuma, informēto piekrišanu noformē rakstveidā, norādot konkrētas ārstniecības rezultāta iespējamās sekas, ar kurām pacients ticis iepazīstināts”. Autore ierosina priekšlikumus normas pareizai piemērošanai, kā arī piedāvā priekšlikumus ārstniecības personas nepienācīgu pienākumu nošķiršanai no nelaimes gadījumiem. Darba gaitā tiek pētīti ārstniecības personas un pacienta tiesību problēmjautājumi.

| dc.description.abstract | Bachelor’s theme is “Medical malpractice”. The author analysis the Article 138 of the Criminal Law of the Republic of Latvia and investigates the legal regulation in foreign law. The author recommends to supplement the Law of the Rights of Patient’s in the paragraph 2 of Article 6 – “Informed consent to one of the treatments enumerated in the Supplement to this Act shall be given by means of a written document with precisely all the possible side effects, pain and discomfort.” The Author gives the suggestions for the proper application of the legal regulation and separates the negligence of the medical practitioner from accidents, and researches the problems between the doctor and patient.
