Darba devēja uzteikumam ir ļoti liela nozīma darba tiesiskajās attiecībās, jo ar darba devēja uzteikumu lielākoties tiek pārtrauktas jebkādas darba attiecības un darbinieka dzīvē sākas jauns posms – darba meklēšana.
Darba devējam, uzsakot darba līgumu darbiniekam, ir cieši jāievēro Darba likumā noteiktās normas un darba uzteikuma kārtība. Ar to jāsaprot, ka darba devējs var uzteikt darba līgumu darbiniekam tikai tad, ja tam par pamatu ir kāds no Darba likumā atrunātiem gadījumiem.
Praksē joprojām Darba likuma normas par darba līguma uzteikumu netiek piemērotas atbilstoši likuma mērķim gan tīši, gan nepareizas izpratnes dēļ.
Šajā darbā tiek apskatīti tādi darba devēja uzteikuma pamati kā:
1) uzteikuma pamati, kas saistīti ar darbinieka uzvedību;
2) uzteikuma pamati, kas saistīti ar darbinieka spējām;
3) uzteikuma pamati, kas saistīti ar uzņēmuma ražošanas nepieciešamību.
Autors darbā ir veicis šo uzteikuma pamatu analīzi, kā arī, tie tiek salīdzināti ar citu valstu praksi un pieredzi. Izvērtējot šos materiālus, tiek konstatētas nepilnības normās, kas regulē darba tiesiskās attiecības. Maģistra darba nobeigumā autors ir izvirzījis priekšlikumus, kas varētu uzlabot un mainīt darba devēja attieksmi pret darba tiesisko attiecību regulējošo normu ievērošanu.

The employer’s notice of termination most often ends any employment relationship between employer and employee and begins a new stage in the person’s life – search for employment.
Employer must very strictly obey the labour law and the procedure of the notice of termination. The employer has rights to fire the employee only in the certain cases of violation of statutes of the correspondent labour law.
In reality the certain statutes of the labour law concerning the procedure of the employer’s notice of termination have been misinterpreted and are being applied incorrectly. Sometimes it happens intentionally, sometimes – because of the ignorance.
This work deals with the following grounds of the employer’s notice:
1)Employer’s notice of termination of the employment relationship caused by the employee’s behaviour;
2)Employer’s notice of termination of the employment relationship caused by the employee’s competence;
3)Employer’s notice of termination of the employment relationship caused by changes in the production situation of the company.
In this work author has analysed the causes of the employer’s notice mentioned above and compared them to the practice and experience in other countries. Evaluating the assessable materials author has detected a number of incompleteness’ in the statutes of the labour legislation. In the concluding part of this work the author has proposed several recommendations which should improve and change the employer’s attitude towards obeying of the labour law.
