Izlīgums civilprocesā

Abstract

Bakalaura darba tēma ir „Izlīgums civilprocesā”. Darba mērķis ir izpētīt izlīguma institūtu civilprocesā un ar to saistītos problēmjautājumus, kas rodas tiesu praksē pie izlīguma noslēgšanas, kā arī sniegt priekšlikumus izlīguma institūta uzlabošanai un pilnveidošanai civilprocesā. Darba uzdevumi ir definēt izlīguma jēdzienu, izskatīt izlīguma noslēgšanas īpatnības dažādās civilprocesa stadijās un izpētīt problēmas, kas rodas tiesu praksē izlīguma noslēgšanas procesā. Pētījuma problēmas būtība ir nepietiekošs tiesisks regulējums civilprocesā par izlīguma noslēgšanas procedūru un tās saturu. Autore nonāca pie secinājumiem, ka Civilprocesa likumā pastāv trūkumi izlīguma institūta sekmīgai regulēšanai, līdz ar to, ir nepieciešami grozījumi. The bachelor thesis topic is Settlement in civile procedure. The aim of the thesis is to explore the settlement institute in civil procedure and related issues arising from the case law when sign an a settlement, as well as to make proposals for a settlement institute improvement and development in civil procedure. The tasks of the thesis is to define the concept of settlement, the review settlement specific character in different stages of civil procedure and explore the issues that arise when sign an settlement. The research is based on the problem that there is not enough legal regulation in civil procedure for the settlement. Author came to the conclusion that there are deficiency in the Civil Procedure Law fot settlement institute's successful regulation, so it is necessary to make changes.
