Saskaroties divām Satversmē garantētām pamattiesībām, tiesībām uz labvēlīgu vidi un īpašuma tiesībām, vienai no tām ir jādod priekšroka. Darba mērķis ir noskaidrot šo pamattiesību mijiedarbību un samērīguma principa piemērošanu to ierobežošanas gadījumā. Darbā ir analizēti īpašuma tiesību ierobežošanas veidi, vides aizsardzības intereses, negatīvā samērīguma principa piemērošana un citi samērīguma principa elementi, kas jāņem vērā ierobežojot personas īpašuma tiesības. Noskaidrojot samērīguma principa piemērošanu, analizēta Satversmes tiesas, Eiropas Cilvēktiesību tiesas un Eiropas Savienības Tiesu prakse.

When two fundamental rights guaranteed under the Constitution – rights to benevolent environment and rights to property collide, one must be preferred. The object of the paper is to determine the interaction of these fundamental rights and application of the principle of proportionality in case of their restriction. Types of restriction of property rights, interests of environment protection, application of the negative principle of proportionality and other elements of the principle of proportionality that must be taken into account in restriction of one’s property rights are analyzed in the paper. In determining the applicability of the principle of proportionality case-law of the Constitutional Court of Latvia, European Court of Human Rights and the Court of Justice of the European Union is analyzed.
