Bakalaura darba „Mantas konfiskācijas regulējums krimināltiesībās” autore, aplūkojot dažādus literatūras avotus un tiesu praksi, analizēja mantas konfiskācijas institūta piemērošanas tendences, savstarpējās atšķirības, aktualitātes un to iespaidu uz turpmāko institūta krimināltiesisko attīstību un to nozīmi krimināltiesībās.
Mantas konfiskācijas kā kriminālsods nesasniedz soda mērķus, neveicina personu resocializāciju, aizskar notiesātās personas ģimenes locekļu intereses, neievērojot kriminālsoda individuālo raksturu, savukārt noziedzīgi iegūtas mantas regulējums būtu uzskatāms par normu ar materiāltiesisku dabu, tāpēc iekļaujams Krimināllikumā.
Eiropas Parlamenta un Padomes direktīva par noziedzīgi iegūtu līdzekļu iesaldēšanu un konfiskāciju paredz tiesiskajā sistēmā ietvert tādus jaunus institūtus kā paplašināto mantas konfiskāciju, ierobežotu konfiskāciju bez notiesājoša sprieduma, pagaidu aktīvu iesaldēšanas procedūru piesardzības nolūkos. Looking in variety of literature and case law, author of Thesis ”Regulation of confiscation of property in criminal justice” analyzed the application trends of the confiscation of property, interrelation and their impact on the future development of the confiscation of property in criminal justice and their role in criminal law.
Confiscation of property as criminal punishment doesn’t reach the goals of punishment, doesn’t promote resocialization, and violates the convicted person’s family interests and disregards individual character of punishment as a penalty of property, while regulation of illegally obtained property should be considered the norm of substantive nature and been included in the Criminal Code.
Directive of the European Parliament and of the Council on the freezing and confiscation of proceeds of crime in the European Union provides to include such new institutes as extended confiscation, seizure of limited confiscation without non-conviction.
