"Saistību bezstrīdus piespiedu izpilde teorijā un praksē"

Abstract

Autore E.Latiša darbā „Saistību bezstrīdus piespiedu izpilde teorijā un praksē” analizēja Civilprocesa likumā regulēto ātro un vienkāršoto saistību izpildes procedūru bezstrīdus kārtībā, tās īpatnības, kā arī to regulējošos normatīvos aktus un judikatūru. Tēma ir aktuāla, jo institūts ir lētāks kā tiesvedība parastā kārtībā, ka arī ātrāks, tādēļ tendences to izmantot pieaug. Autore pirms darba sākšanas izvirzīja hipotēzi, ka bezstrīdus piespiedu izpildē teorija daudzos jautājumus atšķiras no prakses, kas rezultātā apstiprinājās. Saskatot problēmas, kā arī gadījumos, kad prakse atšķiras no teorijā vēlamā rezultāta, autore izteikusi savu viedokli un piedāvājusi problēmu risinājumus. Autore uzskata, ka ir izdevies sasniegt darbā izvirzītos mērķus un uzdevumus, jo SBPI institūta būtība ir izprasta, īpatnības saskatītas, problēmu risinājumi atrasti. Author E.Latiša in her work „Undisputed compulsory execution of liabilities in theory and practice” analized the quick and simple procedure of undisputed compulsory execution of liabilities, governed by Latvian Civil Procedure Law „Civiprocesa likums”, the pecularities, regulations and case law of the institute. The theme is topical and up to date, because this institute is cheaper than legal proceedings in the normal manner, and faster too, so trends of using it increases. Before starting the work, author made a hypothesis, that the undisputed compulsory execution of liabilities in theory are not the same as in practice, and result confirmed this hypothesis. When seeing problems, and when practice is detected different from theory, author expressed her opinion and has offered a solutions to problems. Author believes that she has managed to reach the goals and tasks of this work, because the esence of undisputed compulsory execution of liabilities is understood, pecularities found.
