Pierādīšanas subjekti un pierādīšanas pienākums

Abstract

Pierādīšanas subjekti, kuriem ir pierādīšanas tiesības nav minēti kriminālprocesa likumā. Pierādīšanas Subjektu tiesības izriet no normu interpretācijas, tāpēc tas apgrūtina cilvēktiesību izmantošanu personai, kura ikdienā nesaskaras ar Kriminālprocesa likumu. Pierādīšanas pienākums būtu jāattiecina uz apsūdzēto un aizdomās turēto attiecībā uz alibi norādīšanu. Darba mērķis ir aplūkot pierādīšanas subjektu, pierādīšanas pienākumu lomu, to regulējumu un būtiskumu Kriminālprocesa ietvaros. Lai sasniegtu darba mērķi autors apskatīs Igaunijas Kriminālprocesa regulējumu attiecībā uz darba tēmu. Tiks aplūkota arī tiesu prakse, kas ļaus detalizētāk saprast pierādīšanas pienākumu un pierādīšanas subjektu lomu kriminālprocesā. The Subjects of evidence with the right of proof are not stated in the Criminal Procedure Law. The right of the Subjects of evidence result from the interpretation of norms, therefore the use of Human Rights is complicated for people, who do not come into contact with Criminal procedure law on daily basis. The burden of proof should be extended to the accused and suspects in relation to the alibi indication. The bachelor thesis aims at researching the role of Subjects of evidence, burden of proof their regulation and importance in Criminal procedure. The attention will also be paid to the jurisprudence, in order to acquire more detailed understanding of the burden of proof and the role of Subjects of evidence in criminal procedure.
