The bachelor paper “The object and payers of immovable property tax” studies the concept of the object and payer of immovable property tax, based on case law findings.
It studies whether building that has ceased to exist as well as studies the concept of payer.
This work traces the historical development of the tax, analyses court judgements, provides comparison with foreign states and makes inductive conclusions.
This paper establishes the need to recognize a building as an object until it actually ceases to exist and is deleted from Cadastre Information System. It has been concluded that the concept of payer is broader in reality than in law; specific criteria link the tax to a particular person, not an object. State cannot be the payer of immovable property tax, since it is a duty of a person who has full power over the property.
Keywords: immovable property tax, direct tax, object, payer, case law related to tax issues, local government budget.
