Pierādījumu pieļaujamība kriminālprocesā

Abstract

Bakalaura darbs „Pierādījumu pieļaujamība kriminālprocesā” sniedz ieskatu pierādījumu teorijas aspektā - pierādījumu pieļaujamība. Darba mērķis ir izpētīt pierādījumu pieļaujamības teorētiskos un praktiskos aspektus, kā arī sniegt ieskatu vispārīgajā pierādīšanas teorijā. Darba ietvaros tiek apskatīts jautājums par procesuālajiem defektiem un to ietekmi uz pierādījumu pieļaujamību, kur sīkāk tiek apskatītas iespējamās kļūdas un to ietekme uz pierādījumu pieļaujamību. Pētījuma ietvaros tiek secināts, ka pierādījumu attiecināmība būtu iekļaujama pierādījumu pieļaujamībā. Papildus tam tiek sīkāk izpētīti dažādi aspekti, kas saistās ar pierādījumu pieļaujamību, tās defektiem, un to iespējamo izmantošanu kriminālprocesā. Bachelor’s Thesis „Admissibility of evidence in criminal process” provides an insight in evidence theory aspect - admissibility of evidence. The aim of the research is to study the admissibility of evidence theoretical and practical aspects, as well as provide insight into the general evidence theory. In the research examines the issue of procedural defects and those influence to admissibility of evidence which are mostly discussed about the possible errors and there influence on admissibility of evidence. The main conclusion in this bachelor thesis is that the relevance of proof would need to be included in admissibility of evidence. In addition in the research is examination the various aspects relating to the admissibility of evidence, that errors, and the possible use in criminal proceedings.
