Minoritāšu tiesību uz valodas lietojumu tvērums Eiropas Savienības tiesību avotos

Abstract

Bakalaura darba tēma ir minoritāšu tiesību uz valodas lietojumu tvērums Eiropas Savienības tiesību avotos. Darbā autors ir izmantojis Eiropas Savienības līgumus, Eiropas Padomes nolīgumus, Eiropas Cilvēktiesību tiesas judikatūru, periodiku un citus materiālus. Darba ietvaros tiek noskaidrotas Eiropas Savienības pamatvērtības, no kurām izriet minoritāšu tiesības uz valodas lietojumu un kuras iekļautas Savienības primārajos tiesību avotos.Darba otrajā nodaļā autors aplūko Eiropas Savienības Pamatbrīvību hartas Eiropas Savienības dalībvalstīm saistošā efektīvā Eiropas Cilvēktiesību un pamatbrīvību aizsardzības konvencijas tiesību aizsardzības mehānisma sniegtās atziņas, attīstot to pamatprincipu robežas, kuri attiecas uz minoritāšu tiesībām uz valodas lietojumu. Darba trešajā nodaļā autors pievēršas citu Eiropas Padomes nolīgumu – Eiropas reģionālo vai minoritāšu hartas un Vispārējās konvencijas par nacionālo minoritāšu aizsardzību regulējumam saistībā ar minoritāšu tiesībām uz valodas

The subject of Bachelor's thesis is the scope of the minority rights of language usage in European Union legislation. In making of thesis the author has used the EU Treaties, the agreements of the Council of Europe, the judiciary of European Court of Human Rights, periodicals and other sources. In the course of the thesis those fundamental values of the European Union is cleared, that create the minority rights of language usage arising from the primary EU legal sources – the Treaties. Second chapter of the thesis focuses on the considered-effective mechanism of the European Convention and its judiciary regarding the minority rights of language usage, extending the scope of the principles that relate to these rights. Third chapter of the thesis focuses on the legislation of the minority rights of language usage in Council of Europe treaties such as the European Charter for Regional or Minority
