Darbā apskatīti aktuālie problēmjautājumi sakarā ar ievešanu valdījumā, jo praksē nākas saskarties ar neviennozīmīgu termina „ievešana valdījumā” un tā izpildes procesa tulkošanu un piemērošanu gan zvērinātu tiesu izpildītāju darbībā, gan tiesu nolēmumos.
Darba mērķis ir, izvērtējot pastāvošo normatīvo regulējumu un izpētot tiesu praksi, rast iespēju, kā pēc iespējas efektīvāk aizsargāt un nodrošināt trešo personu tiesības sprieduma piespiedu izpildes procesā - ievedot nekustamā īpašuma jauno ieguvēju valdījumā.
Darbā vispārīgi aplūkoti tiesību subjekti sprieduma izpildē, nolēmuma izpildes būtība un izpētītas īpatnības atsevišķu tiesību subjektu aizsardzībā, ievedot ieguvēju valdījumā.
Tika secināts, ka attiecībā uz īrnieku, nepilngadīgo bērnu un jaunā ieguvēja tiesību aizsardzību, izpildot tiesas nolēmumu, pastāvošais regulējums konkrētos jautājumos nav pietiekams. Normatīvajā regulējumā jāparedz obligātu īres līgumu reģistrēšanu. In the Bachelor`s work topical issues due to an inward posession are discussed because of the reason that in practice we have to face with an ambiguous translation and arrangement of the term „inward posession” although in the action of bailiffs both in court rulings.
The goal of this paper is to find an opurtunity how in the most efficient way to protect and ensure the rights of the third persons in the judgement enforcement process – by entrying the new winner in the possession by assesing existing normative regulations and exploring jurisprudence.
Laws in enforcement of the judgment, content of the enforcement in this paper are general discussed, and peculiarities in separate protection of right – holders by entrying into the possession are explored.
It was concluded that regarding to tenant, minor child and protection of the new holder by executing court`s ruling, the existing regulation in is insufficient in the specific questions.
