Fizisko personu datu aizsardzības princips mijiedarbībā ar informācijas atklātības principu starptautisko tiesību aspektā

Abstract

Datu aizsardzība kā tiesību uz privāto dzīvi elements un informācijas atklātība kā tiesību uz vārda brīvību elements ir demokrātiskas un tiesiskas valsts sastāvdaļa. Pētījuma priekšmets ir personas datu aizsardzība, tomēr jāmin, ka tā ir kļuvusi par šķērsli brīvai datu plūsmai, līdz ar ko šīs tiesības saduras. Autore pētījumā atklāj vārda brīvības un privātās dzīves elementu saturu un izvērtē to savstarpējo mijiedarbību, analizējot pieejamo tiesisko regulējumu un tiesībzinātnieku atziņas, kā rezultātā tiek izdarīti secinājumi. Pētījums veidots, lai ne tikai atklātu iepriekšminēto pamattiesību saturu, bet arī, lai raksturotu pašreizējo datu plūsmas tiesisko regulējumu.

Data protection as an element of the right to privacy, and freedom of information as an element of the right to freedom of expression are the basic components of democratic and legal state. The object of the study is protection of personal data, therefore it should be noted that it has become an obstacle to the free flow of data, showing the interaction of fundamental rights mentioned earlier. This study examines the content of freedom of expression and privacy and evaluates their interaction, based on analysis of available legal framework and doctrine, and also concludes the findings. This study is aimed to reveal the content of the above-mentioned fundamental rights, as well as to describe the present status of transborder data flow regulation.
