Mantas konfiskācija kā kriminālsods būtiski ierobežo notiesātā tiesības uz īpašumu, tās piemērošanas rezultātā būtiski tiek aizskartas trešo personu tiesības un intereses, kā arī nav atrisinātas daudzas problēmas attiecībā uz mantas konfiskācijas izpildes regulējumu.
Šajā pētījumā mērķi bija parādīt šī soda veida problēmas un pierādīt, ka mantas konfiskācija būtu izslēdzama no Krimināllikuma sodu sistēmas, to aizstājot ar speciālo mantas konfiskāciju. Lai sasniegtu šos mērķus, autors izzināja mantas konfiskācijas vēsturisko gājumu, apskatīja dažādu Latvijas un ārvalstu autoru redzējumu attiecībā pret mantas konfiskāciju, izzināja Latvijas tiesu praksi un salīdzināja mantas konfiskācijas regulējumu ar citām valstīm.
Šā pētījuma izstrādes rezultātā autors ieguva pamatotus argumentus par to, ka mantas konfiskācija būtu izslēdzama no Krimināllikuma un guva redzējumu tam, kā būtu jāizskatās jaunajam speciālās mantas konfiskācijas regulējumam. The confiscation of property as criminal punishment considerably limits the felon’s rights to property, in the result of it’s applications third party persons rights and interests are harmed considerably, as well, as of yet, there has not been solved several problems with property confiscation application regulations.
This research’s goals were to show the problems of this criminal punishment and to prove, that the confiscation of property is to be removed from the Criminal Law punishment system by replacing it with special property confiscation. To reach these goals the author studied historical development of civil asset forfeiture, looked into different Latvian and foreign authors points of view in respect of property confiscation, seeking knowledge in Latvian system of justice’s practical experience and compared property confiscation regulations with other country’s regulations.
By completing this research the author gained reasoned arguments in belief of removing confiscation of property from the Criminal Law and gained a view on how the new special property confiscation regulation should look like.
