Bakalaura darbs balstīts uz prakses analīzi un ieteikumu izstrādi izlīguma kriminālprocesā organizēšanā un vadīšanā. Darba pamatā ir Valsts probācijas dienesta, kā galvenā izlīguma virzītājspēka, līdzšinējās prakses analīze un ieteikumu izstrāde. Pētījuma mērķis ir izpētīt izlīguma kriminālprocesā organizēšanu un vadīšanu, veikt prakses analīzi un sniegt ieteikumus tās uzlabošanai. Lai sasniegtu šo mērķi, autore pētīja gan izlīguma vēsturisko, gan procesuālo, gan realizācijas aspektu. Rezultātā autore secina, ka izlīgums ir efektīvs veids, kā atvieglot kriminālprocesu, ka Valsts probācijas dienestam ir izstrādātas efektīvas izlīguma metodes –izlīguma sanāksme un izlīguma sēde. The Thesis is based on the analysis of settlement practices and the development of recommendations for organizing and managing settlement in criminal procedure.
This paper is based on the analysis of existing settlement practice of the National Probation Service, the main driving force behind settlement, and the development of further recommendations.The aim of this paper is to explore the ways of organizing and managing settlement in criminal procedure, perform an analysis of its practices and make recommendations for improvement. To achieve this goal, the author has studied the historical, procedural and implementation aspects of settlement.The Thesis is comprised of three parts.The author concludes that settlement is an effective way to facilitate prosecution, and that that National Probation Service has developed effective settlement methods – the settlement assembly and settlement meeting.
