Kad mēs runājam par mantojuma pieņemšanu, ir svarīgi saprast kā tā ir attīstījusies vēsturiski, un kādēļ tā vispār ir nepieciešama. Mantojuma pieņemšana ir viens no būtiskākajiem posmiem mantojuma procesā.
Latvijas Republikas Civillikums tika pieņemts 1937.gadā un daudzas normas nav grozītas līdz pat šai dienai, tādēļ daudzas lietas tur ir neprecīzas. Šajā darbā autore mēģina izskaidrot atšķirības attiecībā uz mantojuma pieņemšanas formu un termiņiem strap Notariāta likumu un Civillikumu. Civillikums šobrīd neparedz speciālu formu mantojuma pieņemšanai, savukārt Notariāta likums nosaka, ka mantojumu pieņem notariālā akta veidā.
Savos secinājumos darba autore piedāvā veikt grozījumus Civillikuma regulējumā, novēršot atšķirības starp Civillikumu un Notariāta likumu. When we talk about acceptance of the inheritance is important understand how it has evolved historicaly, and why it is generally necessary. Acceptance of the inheritance is one of the most important stage of the inheritance process.
The Civil law of Latvia was adoped in 1937 and many articles was not amened till today, therefore many things there is inacurrate. In this work author was explain differences in form and terms between Notary law and Civil law. Civil law actually does not provide special form to acceptance of inheritance, but Notary law determines that inheritance shall be executed by notary public in the form of a notarial deed.
In conclusions the author offered make a changes in Civil law regulation of heritage, preventing differences between Civil law and Notary law.
