"Apbūves tiesības"

Abstract

Bakalaura darba primārais mērķis ir noskaidrot dalīta īpašuma rašanās iemeslus, identificēt no brīvprātīgi dalīta īpašuma izrietošos problēmjautājumus un apzināt apbūves tiesības institūta saturu. Darba uzdevums ir izvērtēt konkrētu likumprojektu, kas izstrādāts apbūves tiesības institūta ieviešanai Latvijā, salīdzinot to ar Lietuvas Republikas civilkodeksa un Igaunijas Īpašuma likuma tiesību normām šajā jautājumā. Pētījuma rezultātā noskaidrota apbūves tiesības institūta un likumprojekta pozitīvā un negatīvā ietekme attiecībā uz šobrīd praksē iespējamajām problēmsituācijām, kas saistītas ar brīvprātīgi dalītu īpašumu, un to risināšanu, kā arī noskaidrota tā atbilstība likumam.

The main objective of bachelor thesis is to find out the causes of divided property, identify problems which arise from voluntarily divided property and determin the content of the right of superficies. Task of the research is to define a specific bill which is developed to introduce the right of superficies in Latvian law by comparing it with the Civil Code of the Republic of Lithuania and Estonian Law of Property Act on this issue. Result of the study clarifies positive and negative impact of the right of superficies and of the bill according to the problem situations which arise from divided property and also their compliance with the law.
