dc.description.abstract | Būtiskākais valsts pienākums, kas izriet no starptautiskajiem cilvēktiesību dokumentiem, ir aizsargāt indivīda dzīvību. Tādēļ valstis mūsdienās pieņem ar vien vairāk dažādu regulējumu ar mērķi aizsargāt indivīda tiesības uz dzīvību. Taču bieži šādi regulējumi ir pretēji indivīda interesēm, jo tie ierobežo tiesības uz privāto dzīvo, neļaujot lietot veselībai kaitīgus produktus. Neapšaubāmi ir arī produkti, kuri indivīdam sagādā baudu, ja pat tie ir veselībai kaitīgi.
Darbā autors analizēs un secinās, vai paša indivīda dzīvība un veselība var būt tiesisks pamats, lai valsts ierobežotu kaitīgu produktu lietošanu. Kā arī tiks analizēts, vai pastāv citi tiesiski pamati, lai ierobežotu indivīda tiesības uz privāto dzīvi, vienlaikus izskaidrojot, kādēļ visi kaitīgie produkti nav jāierobežo vienlīdzīgi. | en_US |
dc.description.abstract | From the international human rights we can derive that the most important state’s responsibility of all is to protect the life of an individual. That is the reason why nowadays states adopt even more regulations with the aim to protect it. Although, not that rarely such regulations are against one’s interests as they limit the rights to a private life, for example, preventing the use of harmful products. Certainly, there exist products which are pleasurable even if they are harmful to one’s health.
In the paper the author will analyse and conclude whether the life and healthcare of an individual is a legitimate aim for the government to limit the use of harmful products. Additionally, it will be analysed whether there exist other legal basis upon which to limit person’s rights to private life. Furthermore, the paper will explain why each harmful product should not be treated the same as others. | en_US |
