Abstract

Civillikums regulē gan ģimenes tiesību jomu, gan arī ar mantojumu saistītos jautājumus. Ģimenes jēdziens tiek skaidrots lakoniski, taču ģimenes tiesības regulētas plašā spektrā - gan jautājumā par saderināšanos, gan par laulības slēgšanu, šķiršanu un citos. Ģimenes jēdziens ir ietverts Latvijas Republikas Satversmē, tātad tā ir konstitucionāla vērtība. Arī mantošanas jautājumi ir regulēti sīki un strukturēti. Bakalaura darba mērķis ir piedāvāt izveidot jaunu vienotu tiesisku līgumu, kurā būtu apvienots laulības līgums un mantotāja atteikšanās līgums, tā regulējums tiktu ietverts Civillikuma Ģimenes tiesību daļā. Lai labāk saprastu iepriekš minētos tiesiskos darījumus autore apskatīja ne tikai to, kā tie tiek regulēti normatīvajos aktos Latvijā un ārvalstīs, bet arī izpētīja dažādu autoru zinātniskos komentārus un tiesu praksi. Autore darba noslēgumā piedāvā ideju par to, kā un kur šāds tiesiskais darījums varētu tikt regulēts.

In the Republic of Latvia the Civil Law regulate a family law area, as well as an inheritance questions. The concept of family in the Civil Law is explained briefly, although family law is regulated widely - not only on the issue of engagement, but also about the closure of marriage, divorce, ect. Concept of family can be sought in The Constitution of the Republic of Latvia, conesequently it means that family is constitutional value. Inheritance matters also are governed in very detailed and structured way in the Civil Law. Purpose of the Bachelor thesis is to offer a new single legal contract that would be a combination of a marriage contract and a contract to renounce the right of inheritance, regulation of wich should be included in the Family's Law part of the Civil Law. For better understanig of previously mentioned contracts authoress reviewed not only legal framework in the Republic of Latvia and foreign countries, but also explored scientific commentaries and cases.
