Darba meklētāju brīvas pārvietošanās ierobežošanas iespējas Eiropas Savienībā

Abstract

Bakalaura darba mērķis ir noskaidrot iespējamos darba meklētāju tiesību ierobežojumus Eiropas Savienības tiesiskā regulējuma ietvaros. Tiek noskaidrots darba meklētāja statuss un tas, cik lielā mērā darba meklētāja tiesības attiecas uz darba ņēmēju tiesībām. Tiek aplūkoti pastāvošie ierobežojumi darbaspēka brīvai kustībai Eiropas Savienībā un pētīts, vai ir iespējams ieviest papildus ierobežojumus. 2014.gada 1.janvārī pilnībā tika atcelti ierobežojumi, kas tika noteikti pārejas periodā Rumānijai un Bulgārijai pievienojoties Eiropas Savienībai. Tas radīja atsevišķu dalībvalstu diskusijas par to, ka vajadzētu vēl vairāk ierobežot darbaspēka kustību,it īpaši attiecībā uz ekonomiski neaktīvām personām, tai skaitā darba meklētājiem. Darbā tiek pētīts, vai iespējams ieviest ierobežojošākus noteikumus ES attiecībā uz darba meklētājiem, neizdarot grozījumus Līgumā par Eiropas Savienības darbību.

The goal of the Bachelor thesis is to determine the possible restrictions of the rights of work seekers in the European Union within the legal framework. The status of the work seekers is determined and the influence of the work seeker’s rights on the employer’s rights is researched. Current restrictions on the free movement of the workforce within the European Union is examined and a researched on the possibility of new restrictions is performed. On January 1st 2014, the restrictions that were temporarily imposed on Romania and Bulgaria upon entering the European Union were completely annulled. This caused discussions among some member countries about additional restrictions for the movement of the work force, especially regarding economically inactive persons, including work seekers.The thesis analyses whether it is possible to impose additional restrictive measures regarding work seekers within the EU, without breaching the Treaty on the Functioning of the European Union.
