Piegādātāju brīva konkurence, vienlīdzīga un taisnīga attieksme publiskos iepirkumos

Abstract

Bakalaura darbs ietver pētījumu par publisko iepirkumu nacionālo un ES tiesisko regulējumu, publiskā iepirkuma mērķiem - brīvas konkurences, vienlīdzīgas un taisnīgas attieksmes nodrošināšanu publiskos iepirkumos. Pirmajā nodaļā ir veikta publiskā iepirkuma tiesiskās reglamentācijas izpēte gan Latvijas, gan ES aspektā, ar mērķi izklāstīt publiskā iepirkuma būtību un identificēt publiskā iepirkuma mērķus, kā arī ir veikts publiskā iepirkuma mērķu salīdzinājums Latvijā un ES. Otrajā nodaļā ir izvērtēta pasūtītāja un piegādātāja loma piegādātāju brīvas konkurences nodrošināšanā, it īpaši, izvērtējot tiesiskajā regulējumā pasūtītāja noteikto rīcību, kā arī pasūtītāja brīvprātīgo jeb preventīvo rīcību. Trešajā nodaļā tiek pētīta vienlīdzības un taisnīguma principu noteikšana un piemērošana publiskajos iepirkumos. The bachelor thesis contains survey about the national and the EU legal regulation of the public procurement. The first section contains the survey of the regulation of the public procurement from the Latvian and the EU perspective with aim to present the content of the public procurement and identification the public procurement’s objectives, as well as the comparison of the public procurement’s objectives determined in the national and the EU regulation. The second section assesses the role of the commissioning party and the supplier to ensure free competition of the suppliers, especially assessing actions of the commissioning party determined in the legal framework as well as the commissioning party’s voluntary or preventive action. The third section includes study of the principles of the equal and fair attitude and their application within the public procurement.
