Bakalaura darbs „Finanšu ķīla” sniedz ieskatu finanšu ķīlas (turpmāk- FĶ) tiesiskajā regulējumā, kas balansē starp LR Civillikumu kā vispārīgo regulējumu un ar ES Direktīvas 2002/47/EK implantēto Finanšu nodrošinājuma likumu kā speciālo regulējumu. Darba mērķis ir izpētīt finanšu nodrošinājuma tiesisko regulējumu, tā specifiskās īpatnības, darbību LR teritorijā, kā arī apskatīt problēmjautājumus, ar kuriem nākas saskarties.
Darba 1.nodaļā autore aplūkos FĶ tiesību vēsturi un jēdzienu.
2.nodaļā tiks pētītas FĶ būtiskās sastāvdaļas (prasījuma priekšmets, subjekti, spēkā esamība un darījuma prioritāte).
3.nodaļā tiks aplūkoti iespējamie FĶ līgumu veidi - ķīlas līgums ar īpašuma tiesību pāreju un bez īpašuma tiesību pārejas jeb parastais ķīlas līgumu, kā arī tiks apskatītas līdzēju tiesības un pienākumi.
4.nodaļā tiks pētīts FĶ tiesību izbeigšanās, kā arī tiks veikts neliels ieskats maksātnespējas procesā un likvidācijas procesā.
Atslēgvārdi: ķīla, finanšu ķīla, nodrošinājums Bachelor’s Thesis ’’Financial collateral’’ provides an insight into the financial collateral legal regulation, that balances between the Latvian Civil Law as a general regulation and with the EU Directive 2002/47/EC implanted Financial Security Act as a special regulation.
The aim of the research is to investigate the financial collateral’s legislation, it’s specific peculiarities and it’s practice in LR, as well as look at the problematic aspects that we have to face.
In the 1st chapter the author will look at the collateral’s history and concept.
In the 2nd-the author will explore the essential components of collateral (subject of the claim, subjects involved, validity and priority of the transaction).
The 3rd-discusses the possible types of collateral arrangements - pledge arrangementt with the transfer of ownership and without transfer of ownership, as well as rights and obligations of the parties .
The 4th-will examine the insolvency and into liquidation process.
