Valsts amatpersonas statusa nozīme zvērināta notāra un zvērināta tiesu izpildītāja darbībā

Abstract

Darbā tiek pētīta zvērināta notāra un zvērināta tiesu izpildītāja amata darbības duālās dabas mijiedarbība ar valsts amatpersonas statusu. Darbā galvenās aplūkotās problēmas ir saistītas ar zvērināta notāra un zvērināta tiesu izpildītāja statusa konkretizēšanu, iespējamību uz minēto profesiju pārstāvjiem attiecināt likumu „Par interešu konfliktu novēršanu valsts amatpersonu darbībā” un Latvijas Republikas pilsonības nosacījuma pamatotību. Autoresprāt, tiesu praksē un iestāžu lēmumos nepastāv vienotas izpratnes par minēto profesiju pārstāvju darbību un tās regulējumu. Šī darba mērķis ir noskaidrot, vai ir iespējams savienot brīvās juridiskās profesijas pārstāvja darbību ar valsts amatpersonas statusu dažādu tiesību normu izpratnē un vai pilsonības nosacījums minēto profesiju pārstāvjiem ir pamatots un atbilstošs Eiropas Savienības tiesību normām, balstoties uz to īpašo statusu un valsts varas realizēšanas faktu. Darba rezultātā autore secina, ka zvērināts notārs un zvērināts tiesu izpildītājs ir valsts amatpersona, taču to darbības forma ir specifiska, tādēļ ne visas likuma „Par interešu konfliktu novēršanu valsts amatpersonu darbībā” tiesību normas iespējams attiecināt uz minēto profesiju pārstāvju darbību. Savukārt pilsonības nosacījums zvērinātiem notāriem un zvērinātiem tiesu izpildītājiem ir pamatots, jo minēto profesiju pārstāvji īsteno valsts varu. Bakalaura darbs sastāv no ievada, trijām nodaļām un septiņām apakšnodaļām, kopsavilkuma, un izmantotās literatūras un avotu saraksta.

The Bachelor Paper investigates duality of interaction between the professional activity of sworn notary and sworn bailiff, and the status of a public official. The main issues of the Paper deal with specifying the status of sworn notary and sworn bailiff; possibility of applying to the mentioned professions the law On Prevention of Conflict of Interest in Activities of Public Officials, and justification of the requirement for citizenship of the Republic of Latvia. In the opinion of the author, case law and decisions of judicial authorities do not provide uniform understanding of activity of the mentioned professions and its legal order. The objective of the Paper is to clarify whether it is possible to combine freelance legal job with the status of a public official in the understanding of various legal norms; whether the requirement for Latvian citizenship to representatives of the mentioned professions is justified and complies with the legal norms of the European Union by virtue of their special status and the function of exercising of public authority. In the end the author concludes that sworn notary and sworn bailiff are public officials, however their activity is specific, therefore not all legal provisions of the law On Prevention of Conflict of Interest in Activities of Public Officials apply to the activity of these legal professions. In turn, the requirement for Latvian citizenship of sworn notaries and sworn bailiffs is justified since they exercise public authority. The Bachelor Paper consists of: introduction, three chapters and seven sub-chapters, conclusion, literature and references.
