"Testamenta forma "

Abstract

Darbā tika izskatīti Civillikuma Mantojuma tiesību daļas aktuālākās izmaiņas, kas saistītas ar testamenta formu. Darbs sastāv no piecām nodaļām. Darba pirmajā nodaļā tika aprakstīta vispārējie testamentārās mantošanas noteikumi un testamenta formas raksturojums. Otrā, trešā un ceturtā nodaļa ietver Latvijas Republikas Civillikuma Mantojuma tiesību daļas testamenta formu veidus, analizējot tiesu praksi un ņemot vērā Seimā trešajā lasījumā pieņemtos grozījumus, kas attiecas uz testamenta formu. Tika salīdzinātas arī atšķirības starp Latvijas testamentāro mantošanu ar Romiešu laika tiesību testamentāro mantošanu, kā arī Latvijas mantošana salīdzināta ar Lietuvas likumu par mantošanu.

In the paper were discussed Civil law’s The part of inharitance the most actual matters, which connnected with the form of testament. Work consists of four chapters. In the first chapter is given the general description of rules of the form of testament, and the discription of the form of testament. The second, third and fourth chapter include Latvia’s Civil law’s The part of inheritance the form of testament types, analysing jurisprudence and including also in Saeima in 3rd reading accepted amendments, which concerns to the form of testament. Have been done the compare of the inheritance of Latvia’s Civil law with the Roman law inheritance, and also Latvia’s testamentary inheritance compared with Lithuania’s Civil Code of inheritance.
